The Silent Conspiracy: How Power Play Reshapes Justice
This revelation is no small matter. It means that Justice Qazi aided their efforts, giving them the judicial leverage they needed. Without his cooperation, they wouldn’t have had the opportunity to push these amendments through. Qazi played a pivotal role, in clearing the path, removing hurdles, and providing the assistance necessary for the approval of these amendments. This isn’t just about a minor favor; it’s about judicial facilitation that altered the political landscape.
A Reversal of Decisions
To understand the full extent of this, we need to go back to a decision by former Chief Justice Umar Ata Bandial. His ruling on Article 63(A) of the Constitution deeply frustrated the PML-N and PPP. It was the time when some members of Imran Khan's party defected and voted against him in the no-confidence motion. When the matter reached the Supreme Court, Justice Bandial's decision, which was also supported by Justice Munib Akhtar, declared that any member who votes against the direction of their party leader would not only have their vote disqualified but would also be de-seated.
This ruling was a major blow to the government. They filed an appeal for a review of this decision, but nothing happened for two years—until Qazi Faez Isa took over as Chief Justice. Suddenly, that old review petition was brought to light, and in a strategic move a few days before the passing of the constitutional amendment, Qazi assembled a five-member bench, placing himself at its helm. This bench reversed the earlier decision, stating that while members would still be disqualified for voting against party lines, their votes would now be counted.
A Carefully Laid Plan
This move opened the floodgates. With the decision reversed, the government now had the legal backing to count the votes of those who defected. They swiftly moved forward with their constitutional amendments. They had already managed to pull defectors from the PTI, and with these seven additional votes, they secured the approval of the amendments. Bilawal Bhutto openly admitted that this would not have been possible without Qazi’s cooperation. This might not have happened if any other chief justice had been in power. Bilawal’s words implied that no other judge would have been willing to stoop so low, that no other judge harbored such disdain for Imran Khan.
